Carlos Ghosn fled Japan and ended up wanted on an INTERPOL Red Notice. Vijay Mallya left India and spent close to a decade fighting extradition in UK courts. Same kind of alert, wildly different consequences.
Confuse the two during a background check, and you either kill a deal that never needed killing, or you sign off on a partner whose legal exposure just became yours too.
Here’s what actually separates the two, and what to check the moment one shows up on a name you’re screening.
Red Notice vs Arrest Warrant at a Glance
| What to Compare | Interpol Red Notice | National Arrest Warrant |
|---|---|---|
| Who issues it | INTERPOL, at a member country’s request | A court in that country |
| What it’s built on | An existing national warrant or court ruling | A criminal charge or conviction |
| Reach at the border | Depends entirely on the receiving country’s own law | Loses force the moment someone leaves the country |
| Legal weight | A request for police cooperation, not a court order | A binding order inside the issuing country |
| Extradition | Local police and courts decide what to do with it | Extradition, or a comparable legal process, usually follows |
What Does an Interpol Red Notice Mean?
INTERPOL forwards the flag to police, border, and immigration authorities throughout the world. INTERPOL reviews all notices forwarded against Article 3 of its constitution but does not investigate or prosecute offenses; the member countries are responsible for the prosecution of these offenses. Article 3 prohibits offenses based upon motive (political, military, religious, or racial), and INTERPOL independently removes all civil/personal disputes from consideration. This is why qualifying offenses fall into a relatively narrow band: murder, fraud, drug trafficking, and organized crime.
Beyond this point, INTERPOL has no further role. INTERPOL itself can create no obligation with regard to the detention of an individual who has been flagged by INTERPOL; it will be up to the laws of the country where the individual is located as to whether they will be detained or otherwise act on the information provided by INTERPOL.
What Is an International Arrest Warrant?
A national court issues an arrest warrant for a criminal charge or a conviction, and that warrant carries force only inside the country that issued it. Getting it recognized abroad takes one of three routes: an extradition treaty between the two countries, a formal legal assistance request, or INTERPOL’s own network, which is also how a warrant can turn into a Red Notice request.
Mallya’s case shows how slow that route can get. He left India in 2016 amid a loan default and a money laundering investigation, and INTERPOL turned down India’s first Red Notice request because no extradition case had been filed yet. India extradited him anyway, years later, through a 1993 treaty with the UK, arguing the case through Westminster Magistrates’ Court and then the UK High Court.
What Determines Whether a Country Extradites Someone?
None of that involves a Red Notice. Four things determine whether a country hands someone over:
- A treaty, or at least an established practice of cooperation, between the two countries
- Dual criminality, meaning the offense counts as a crime in both places, not just one
- A request that stays clear of any political motive, since political offenses get carved out almost everywhere
- A citizenship status that allows extradition, since plenty of countries refuse to extradite their own nationals regardless of treaty
That citizenship rule is what kept Ghosn free in Lebanon. Japan issued a Red Notice against him the moment he fled there in 2019, and Lebanon simply moved on, since it has no extradition treaty with Japan and rarely hands over its own citizens; he lived openly in Beirut for years afterward. Mallya never had the same shield, since his Indian citizenship gave him no protection once he was in Britain.
How Is a European Arrest Warrant Different From a Red Notice?
Inside the EU, none of that four-part test applies. A European Arrest Warrant binds every member state automatically the moment one country issues it, comes with real deadlines, and leaves almost no room to refuse.
Sweden requested an EAW and a Red Notice against Julian Assange at the same time in 2010. London police arrested him under the EAW, and the UK Supreme Court’s 2012 ruling on his extradition turned entirely on the EAW’s validity. The Red Notice played no role, since the EAW already did everything a Red Notice could have.
If you’re screening an EU national, act on an EAW hit right away. A Red Notice hit alone, with no EAW behind it, usually needs nothing further from you.
What Does a Red Notice Match Mean for Your Business?
A match ties someone’s identity to an international wanted-person alert, nothing more. Confirm it before treating it as a conviction or a ban on doing business with that person:
- Confirm the match with more than a name, using date of birth, nationality, or another identifier
- Find out which country issued the warrant and what the actual charge is
- Check whether the record is still active, since INTERPOL deletes and refuses notices on review
That public layer is scattered across hundreds of national court systems, in dozens of languages, updated on no fixed schedule, so checking it manually for every new name isn’t realistic. A live database of national warrant and criminal entity records pulls that layer into one searchable place: national warrants, court records, and any Red Notices INTERPOL has published. It won’t surface a red notice. INTERPOL is restricted to law enforcement, since nothing outside that network can.
Is a Red Notice the Same as a Sanctions or PEP Listing?
Each record covers different ground, and a hit in one says nothing about status in the other two.
| Record type | What it means |
|---|---|
| Warrant and criminal entity record | Wanted for prosecution, serving a sentence, or flagged as a criminal entity |
| Consolidated sanctions listing | Designated under a specific sanctions program |
| Politically exposed person record | Holds, or sits close to, a prominent public role |
Check each category on its own instead of assuming one covers the rest. See how this data gets sourced and verified in the full data catalog.
What to Do With a Red Notice or Warrant Hit?
- Act immediately on an EAW hit for an EU national; treat a standalone Red Notice as a flag to watch, not an automatic block
- Screen for sanctions, PEP status, and criminal warrants separately, since a hit in one says nothing about the other two
- Get legal or compliance input before you freeze an account or walk away from a deal
- Run every name against verified sanctions, PEP, and warrant data rather than a single Red Notice lookup, or reach out to talk through the screening process.
A Red Notice on its own does not tell you what action to take. It tells you that the person needs a closer look. The same applies to a warrant hit: confirm who the person is, understand what the alert relates to, and check the other relevant screening results before deciding whether there is a reason to act. In other words, a hit is a signal to investigate, not an automatic block.

Frequently Asked Questions
Does a Red Notice count as an arrest warrant?
It’s a request for police cooperation, built on a national arrest warrant that already exists, and it carries fairly limited authority on its own.
Can someone get arrested off a Red Notice?
In countries willing to treat it as grounds for a provisional arrest, yes. Others wait for their own legal steps to play out first.
Does a Red Notice mean someone is guilty?
It covers people wanted for prosecution just as much as people already convicted and wanted to serve a sentence. The notice itself decides nothing about guilt either way.
Can a Red Notice get pulled?
Yes. INTERPOL deletes or refuses notices that break its own rules, including any built on political, religious, racial, or military grounds.
Is a Red Notice the same as an extradition request?
A Red Notice helps locate someone and can support a provisional arrest. Extradition is a separate legal process between two countries that follows well afterward, if it happens at all.
